1. Agreement to Terms

By accessing or using TrueCare Home Services ("we," "our," or "us"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services.

2. Services Description

TrueCare Home Services provides non-medical home care services including but not limited to:

  • Personal care assistance
  • Companionship services
  • Homemaker services
  • Respite care
  • Specialized care for conditions such as dementia and Alzheimer's

Our services are non-medical in nature and do not include medical treatments, diagnoses, or procedures.

3. Eligibility and Application

To receive services from TrueCare Home Services:

  • You must complete our application process
  • You must provide accurate and complete information
  • You must be a resident of the Atlanta Metro area or surrounding counties we serve
  • You may need to meet certain eligibility requirements for Medicaid-funded services

4. Client Responsibilities

As a client or family member, you agree to:

  • Provide a safe working environment for our caregivers
  • Treat all staff members with respect and dignity
  • Communicate any changes in care needs or health status promptly
  • Pay for services according to the agreed-upon payment terms
  • Provide accurate information about the care recipient's condition and needs
  • Notify us immediately of any concerns or incidents

5. Payment Terms

Payment for services may be made through:

  • Private pay arrangements
  • Medicaid reimbursement (for eligible clients)
  • Long-term care insurance (where applicable)

Payment terms will be outlined in your individual service agreement. Late payments may result in suspension or termination of services.

6. Scheduling and Cancellations

We strive to accommodate your scheduling preferences. However:

  • Schedule changes must be requested at least 24 hours in advance when possible
  • Emergency cancellations will be accommodated but may affect service continuity
  • Repeated last-minute cancellations may result in service termination
  • We reserve the right to adjust schedules based on caregiver availability

7. Privacy and Confidentiality

We are committed to protecting your privacy and maintaining the confidentiality of your personal and health information in accordance with HIPAA and other applicable privacy laws. Please refer to our Privacy Policy for detailed information about how we collect, use, and protect your data.

8. Limitation of Liability

While we take every precaution to ensure quality care:

  • TrueCare Home Services provides non-medical care only
  • We are not responsible for medical decisions or medical care
  • Clients should maintain relationships with their healthcare providers
  • We are not liable for pre-existing conditions or medical emergencies beyond our control
  • Our caregivers will follow emergency protocols and contact appropriate medical services when needed

9. Termination of Services

Either party may terminate services with reasonable notice. We reserve the right to terminate services immediately if:

  • The client or family members engage in abusive or threatening behavior
  • Payment obligations are not met
  • The environment becomes unsafe for our caregivers
  • The client's needs exceed our scope of non-medical care
  • Fraud or misrepresentation is discovered

10. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions.
